Terms and Conditions

Payments

All clients of CrossFit Hibiscus Coast are to ensure their payments are up to date at all times. It is your responsibility to ensure your payments are made, and you understand that all payments must be made in advance and paid in full.

  1. All clients on the Ezidebit plan understand that they are locked in for 8 weeks when starting or restarting payments. All clients on any other payment understand that they are paying in advance. A weeks training is Monday to Saturday in all instances.
  2. All clients on the Ezidebit plan understand that there is a $5.50 set up fee (one off) and a $1.15 transaction fee for each payment. You also understand that a dishonour fee of $14.95 is deducted if there are insufficient funds available when payments are due.
  3. All clients understand that 14 days notice in writing (via text or email) is required when wanting to place payments on hold or wanting payments to be ceased.
  4. All clients on the two and three sessions per week membership understand that sessions must be used on the given week and cannot be saved up. All clients on concession cards must use the sessions within the given periods. CrossFit concession cards have a 3 month expiry.
  5. CrossFIt Hibiscus Coast has the right to alter payment options to suit special circumstances.
  6. All clients understand that no classes are Free. (this includes specialty classes)
  7. All clients understand that CrossFit Hibiscus Coast has the right to increase payments on an annual basis. CrossFit Hibiscus Coast will give at least 4 weeks notice in writing (email) prior to any payment increase.
  8. All clients on a Loyalty Rate understand that if they place payments on HOLD or CEASE then they will be on the Standard Rates when restarting.
  9. All clients on a Loyalty Rate understand that their payments may be increased annually to eventually align with the Market Rate.

Operating Hours

  1. All classes at CrossFit Hibiscus Coast are scheduled and booked via the Gym Mate System. You will understand that it is your responsibility to book classes prior to training. You also understand that you must cancel any intended bookings within 2 hours of scheduled classes.
  2. All clients understand that penalties may be applied if you fail to cancel classes.
  3. All clients understand that any CAPS on classes will be adhered to, and you understand that you do not have the right to enter the class without the permission of the duty trainer.
  4. All clients understand that they have read and should follow the rules and guidelines of CrossFit Hibiscus Coast. Special mention goes to arriving on time, listening to the trainers professional advice, looking after equipment, keeping the premises clean and tidy and supporting each other.
  5. All clients not on unlimited sessions, understand that Open Gym does count as a class. All clients will ensure they have packed up all equipment from Open Gym prior to any scheduled class.
  6. Trial Sessions are offered to personnel wanting to try our services (must be pre booked by the individual). If they sign up for the Elements course or for a membership (on the day of the trial), then the session is FREE. If they do not sign up on the day then they understand that a payment of $25 is required to cover the session.
  7. All clients understand that they should not interfere with scheduled classes if arriving early or departing late. Therefore not interrupting class members under instruction or interrupting the duty trainer whilst instructing. All members understand that it is not a right to do extra training in other classes and that it is a privilege.
  8. All clients understand that CrossFit Hibiscus Coast has the right to be CLOSED on Public Holidays, Recognised Public Holidays and Sundays. All clients also understand that CrossFit Hibiscus Coast has the right to give 24 hours notice if required to close at short notice due to any unforeseen circumstance.
  9. All clients understand that parking in other business car parks is done so at their own risk.
  10. All clients understand that they may be removed from classes if not adhering to trainers instructions or disrupting classes.
  11. All clients understand that safety is the absolute priority at CrossFit Hibiscus Coast. This is safety in all manners and may relate too but not restricted to the following means: (Personal Safety whilst training, Safety with equipment, Safety with Hazards, Safety with other members). Any safety breaches must be brought to the trainers attention straight away and any instruction will cease until the issue has been resolved. Any safety issues will be recorded.

Rights as a Client

As a client you have the following rights:

  1. The right to withdraw from exercise at any time under any circumstance.
  2. Full rights under the privacy act (these can be found at www.privacy.org.nz). All information collected by the trainers is for their professional use only regarding your wellbeing, background and contactable information.
  3. Right to complain about any matter which gives you concern. Complaints in the first instance should be raised with the party directly involved. Where a suitable resolution can not be found you can discuss with the trainers or the complaint should be raised with the appropriate agency under general law.

Owner / Operator Rights

The owner / operator of CrossFit Hibiscus Coast has the right to:

  1. Amend or Update the Terms, Policies and Conditions at any time. The latest signed copy of the Terms, Policies and Conditions will always be on the CrossFit Hibiscus Coast noticeboard.
  2. Amend operating schedule of CrossFit Hibiscus Coast at any time.

Liability Waiver

All personnel intending on training under the guidance and instruction of CrossFit Hibiscus Coast are to read and follow the following Terms, Policies and Conditions. Completing and signing the Consultation Form or Waiver form must be done prior to any training session and this acknowledges that you will adhere to our Terms, Policies and Conditions. If you have any medical history then it is your responsibility to advise the duty trainer. All clients understand that any training at CrossFit Hibiscus Coast is done at their own risk and they indemnify CrossFit Hibiscus Coast and their trainer(s) against all risks involved.

Safety, Preparation and Recovery

Safety: Any person that trains at CrossFit Hibiscus Coast are under the guidance of the duty trainer at all times. You agree to follow their instructions in order to maximise safety. This includes adhering to preparation and recovery practices. You are to be medically fit to undertake physical activity to your capabilities. You understand that you have the right to withdraw from training at any time and that you are doing the prescribed programming voluntarily.

Rest: All clients of CrossFit Hibiscus Coast are encouraged to be fully rested and are recommended to not train more than 3 days consecutively. You are encouraged to rest for at least 12 hours prior to training again and to get at least 7 hours sleep in order for your body to become rested and recovered. Rest is an individual's responsibility and should be programmed into your week.

Nutrition: All clients of CrossFit Hibiscus Coast are to ensure they have eaten a nutritional meal within 2 hours of training and consumed at least 500ml of water within 1 hour of training. Early morning clients should consume fruit prior to your session. Additionally clients are advised to consume at least 500ml of water post workout and be prepared to eat a nutritional meal within 2 hours of post workout. Nutrition is a fundamental part of preparing and recovery around exercising.

Medically Fit: All clients understand that it is your responsibility to be medically fit to train at CrossFit Hibiscus Coast. If there is any doubt, whatsoever with your medical condition then it is your responsibility to obtain clearance from your Medical Professional (GP).

Injury or Illness: All clients of CrossFit Hibiscus Coast are advised that if they are ill or injured then they should not be training. It is your responsibility to manage your wellbeing accordingly. Should you become ill or injured after training, then you should contact your health professional. Should you experience any form of chest pain, shortness of breath, feeling faint or loss of coordination then you should go to an Emergency Clinic or call 111 immediately. Should any of the mentioned guidelines not be followed then you do so at your own risk !
